Elon Musk has no intention of burying the hatchet against OpenAI and has now requested the removal of Sam Altman and Greg Brockman, CEO and president respectively of the parent company of ChatGPT, as part of a lawsuit filed by the South African entrepreneur that could go to trial later this month.

In a court document filed Tuesday, Musk’s legal team outlines the specific measures their client is seeking should the trial determine that OpenAI and Altman committed fraud against the world’s richest man. The removal of Altman and Brockman is one of those specific measures.

Musk sued Altman and OpenAI in 2014, alleging that the AI ​​company, which he helped found a decade ago, repeatedly «manipulated» and deliberately «deceived» him into donating $38 million based on promises that the company would remain a non-profit organization at all times. Since then, Musk and OpenAI have been embroiled in a bitter war of words (which has also included legal battles between both sides).

Musk’s lawyers argue that removing the CEO and president of a non-profit organization is standard practice when those positions fail to adequately uphold the organization’s original mission.

The trial to resolve Musk’s lawsuit against OpenAI will be held in a federal court in Oakland, California, and jury selection is scheduled for April 27.

Musk is seeking up to $134 million in damages from OpenAI.

In his lawsuit, Musk is also asking the court to order OpenAI to operate as a genuine non-profit organization. Last October, the company underwent a restructuring, and since then, OpenAI has operated as a non-profit entity with a 26% stake in the startup’s for-profit division.

OpenAI has not remained passive in the face of Elon Musk’s latest attacks. In a post published on the social network X, the company laments that the South African’s lawsuit «is nothing more than a harassment campaign driven by ego, jealousy, and a desire to stifle a competitor at all costs.»

Musk, Altman, and other entrepreneurs co-founded OpenAI as a non-profit AI lab in 2015. Musk severed ties with OpenAI in 2018 after unsuccessfully attempting to convince company executives to merge the startup with Tesla, his electric car company.

In 2023, Musk launched xAI, his own AI company. And just a couple of months ago, in February of this year, SpaceX, Musk’s aerospace company, acquired xAI, which is the parent company of X, the social network formerly known as Twitter, in a transaction that gave the resulting company a combined value of $1.25 trillion.

Last Monday, OpenAI sent a letter to the attorneys general of California and Delaware urging them to investigate the «improper and anticompetitive behavior» of Elon Musk and his legal team before the trial that will pit both parties against each other in court. In that letter, Jason Kwon, Chief Strategy Officer of OpenAI, accuses Musk of trying to harm the parent company of ChatGPT by perpetrating attacks against the company that include «coordinating efforts» in collusion with Mark Zuckerberg, CEO of Meta.

In a statement released last January, Musk’s lawyers said their client expected to receive up to $134 billion in damages from OpenAI and its main investor, the software giant Microsoft.
